Web-Beacon

A small graphic known as a web beacon may be embedded into Truxgo advertisements, emails or web pages. This is a small graphic that will result in your web browser requesting the beacon from a web server. This request results in your web browser acquiring a unique identifier that may track visitor movement on the website utilizing the web beacon. Truxgo uses web beacons to provide customized offers and gain usage statistics that help tailor the most desired viewing experience for the majority of our visitors. No personal information is read by Truxgo's web beacon other than raw usage statistics.

For the purpose of these Terms of Services, we define 'Content' as information and data in all forms (text, images, software, applications etc.) that is published, transmitted or otherwise stored on the hosting platform provided by Truxgo - Including all user related content entered in the Client Portal upon registration.

Customer Content Responsibility

Content of any form published, transmitted and stored using Services provided by Truxgo is the full responsibility of the user/account owner. You accept that you are responsible to abide by laws, rules and regulations - any conflicting actions taken are at your own risk - and fully responsible for any damage, or loss that you may have experienced or caused to a third party as a result of your own actions.

Truxgo Content Responsibility

Truxgo cannot monitor, verify, warrant, or vouch for the accuracy and quality of the information that subscribers may acquire. For this reason, the subscriber must exercise his or her best judgment in relying on information obtained from the Internet, and also should be aware that some material posted to the Internet is sexually explicit or otherwise offensive. Because Truxgo cannot monitor or censor the Internet, and will not attempt to do so, Truxgo cannot accept any responsibility for injury to its subscribers that results from inaccurate, unsuitable, offensive, or illegal Internet communications.

Limitations of Truxgo

Truxgo does not review, edit, censor, or take responsibility for any information its subscribers may create. When users place information on the Internet, they have the same liability as other authors for copyright infringement, defamation, and other harmful speech. Subscribers' postings to the Internet may affect other subscribers and may harm Truxgo's goodwill, business reputation, and operations. For these reasons, subscribers violate Truxgo policy and the service agreement when they, their customers, affiliates, or subsidiaries engage in the any prohibited activities.

Truxgo Intervention

Truxgo will not, as an ordinary practice, monitor the communications of its subscribers to ensure that they comply with Truxgo policy or applicable law. 

Acceptable Use Policy (AUP) for VPS and Cloud Services

This Acceptable Use Policy ("AUP") outlines the rules and guidelines for the proper use of Virtual Private Server (VPS) and Cloud services provided by [Truxgo Servers]. By using our services, you agree to comply with the provisions of this AUP. Violation of this policy may result in the suspension or termination of the service.

1. Legal Use and Compliance with Regulations
VPS and Cloud services must be used in accordance with all applicable local, national, and international laws. It is strictly prohibited to use our servers for illegal activities, including but not limited to:

Copyright, patent, or trademark violations.
Distribution of obscene, defamatory, or hate-promoting content.
Fraud, scams, or phishing.

2. Spam and Unsolicited Emails
Sending unsolicited emails (spam), including bulk commercial emails or any unauthorized marketing messages, is strictly prohibited. Users must obtain prior approval from [Truxgo Servers] before engaging in any activity involving mass email sending. Violating this policy may result in the immediate suspension or termination of the service.

2.1. Notification Required for Mass Emailing
If you wish to send mass emails using our VPS or Cloud services, you must notify our support team beforehand. The team will review your request to determine if such activity is permitted under our policies and ensure compliance with current anti-spam regulations.

3. Security and Protection
Users are responsible for maintaining the security of their VPS or Cloud server. This includes:

Applying security patches and updates in a timely manner.
Implementing strong passwords and two-factor authentication where possible.
Not engaging in hacking activities or system breaches, either within or outside our network.

4. Resource Usage
Users are expected to use VPS and Cloud resources (CPU, memory, storage, bandwidth) in a fair and responsible manner. Any abuse of resources that impacts the stability or integrity of our shared servers or infrastructure may result in restrictions or suspension of the service.

5. Prohibition of Malicious Activities
The use of our services to conduct any form of attack on other servers, networks, or users is prohibited, including but not limited to:

Denial-of-service (DDoS) attacks.
Unauthorized port scanning.
Unauthorized access to or use of other network systems.

6. Content Distribution
The storage or distribution of the following types of content is strictly prohibited:

Material promoting terrorism or violent activities.
Malicious software, viruses, trojans, or any other form of malware.
For the storage or distribution of pornography, users are strongly encouraged to consult with our support team to verify whether it is allowed and determine if it complies with the legal standards of the region or locality where the VPS or Cloud server is being used.

7. Consequences of Violations
Violation of this Acceptable Use Policy may result in disciplinary actions, including:

Warnings.
Suspension or termination of the VPS or Cloud service without prior notice.
Legal liability and cooperation with authorities if necessary.

8. Modifications to the AUP
We reserve the right to modify this Acceptable Use Policy at any time. Users will be notified of any significant changes, and continued use of the services after such notification implies acceptance of the changes.
